14. Dispute Resolution and Arbitration
This section outlines the procedures for resolving disputes between you and DojoWell, including informal resolution, arbitration requirements, and limitations on class actions.
14.1. Informal Dispute Resolution
DojoWell aims to resolve disputes amicably before resorting to legal action. If you have a concern or disagreement with DojoWell:
1. Contact Us First: You must send a written notice describing the issue in detail to helpdesk@dojowell.com
2. Good-Faith Effort: Both parties will engage in good-faith negotiations for at least 30 days to resolve the matter informally.
3. Proceeding to Arbitration: : If the dispute is not resolved within 30 days, you or DojoWell may initiate arbitration (outlined in Section 14.2).
Failure to engage in informal resolution before initiating arbitration may result in the dismissal of your claim.
14.2. Binding Arbitration
If a dispute cannot be resolved informally, you and DojoWell agree to resolve it exclusively through binding arbitration, rather than in court.
- Governing Law: The arbitration process will be governed by the Federal Arbitration Act (FAA) and conducted by a neutral arbitrator instead of a judge or jury.
- Arbitration Administrator: Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

If any part of this section is found unenforceable:
- The remaining provisions will remain in effect.
- If the class action waiver (Section 14.3) is invalidated, then the entire arbitration agreement is void, and disputes will be resolved in a court of law instead.

- No modification or waiver of these Terms shall be valid unless in writing and explicitly agreed upon by both parties.
15.4. Severability
If any provision of these Terms is found to be unenforceable or invalid:
- That provision will be modified or removed to the extent necessary, but the remaining provisions will remain in full force and effect.
- If the modification is not possible, the unenforceable provision will be severed, and the rest of the Terms will continue to apply.

DojoWell is not responsible for any delay or failure to perform its obligations due to:

- Any other unforeseen circumstances beyond our reasonable control

- If DojoWell delays or fails to enforce any provision of these Terms, this does not constitute a waiver of that provision or any other rights under these Terms.
