The short version. These Terms are the contract between you and Establishment Dojo Tech (the company that builds DojoWell). By using our website, apps, or content, you agree to them. DojoWell is informational and does not provide medical or therapeutic care. Subscriptions auto-renew. Disputes are governed by Saudi law. Nothing here removes consumer rights you have under your local law.

Welcome

Welcome to DojoWell. These Terms & Conditions (the "Terms") are the agreement between you and Establishment Dojo Tech (referred to as "DojoWell," "we," "us," and "our") — the company that builds and operates DojoWell, a meaning-density framework that helps people complete loops, build stable habits, and find meaning in everyday life.

These Terms apply when you use any part of DojoWell: our website at dojowell.com, our mobile apps on the App Store and Google Play, our content (articles, art, audio, journeys, quizzes), and our paid subscriptions.

We have written these Terms in plain language wherever the law allows. Where legal precision is needed, we have added a short summary at the top of each section explaining what it actually means. Please read carefully — by using DojoWell, you agree to be bound by these Terms.

1. About These Terms

In short: These Terms are a contract. By using DojoWell, you accept them. We can update them, and we will give you advance notice for any change that affects your rights.

1.1 Who is offering the service

DojoWell is operated by Establishment Dojo Tech, a sole-establishment registered in the Kingdom of Saudi Arabia.

1.2 Acceptance of these Terms

By creating an account, downloading our app, accessing our website, or using any DojoWell service, you confirm that (i) you have read these Terms, (ii) you agree to be bound by them, and (iii) you meet the eligibility requirements in Section 2. If you do not agree, you must not access or use DojoWell.

1.3 Other policies that apply

The following policies are incorporated into these Terms by reference and form part of your agreement with us:

  • Our Privacy Policy — how we handle your personal data.
  • Our Refund Policy — how subscription refunds work.
  • Apple Media Services Terms (for iOS in-app subscriptions).
  • Google Play Terms of Service (for Android in-app subscriptions).
  • Paddle Buyer Terms (for web subscriptions).

1.4 Changes to these Terms

We may update these Terms from time to time — for example, when we add features, adjust pricing structures, or comply with new laws.

For material changes (changes to fees, liability, the dispute-resolution clause, the licence we grant you, or your account-termination rights), we will: (i) update the "Effective Date" and "Last Updated" at the top of this document; and (ii) send notice to your registered email address and/or post a notice in the app at least 30 days before the changes take effect.

For non-material changes (clarifications, typo fixes, minor wording), we may update the Terms without prior notice. Your continued use of DojoWell after the Effective Date of the new version means you accept the updated Terms. If you do not accept them, you must stop using DojoWell and may cancel your subscription as set out in Section 4.

1.5 Language

These Terms are written in English. We may publish translations for convenience (Arabic, Spanish, French, Hindi, Chinese), but the English version is the binding version. In case of any conflict between a translation and the English original, the English version controls.

2. Eligibility & Your Account

In short: You must be 13 or older. Under 18, you need a parent or guardian's permission. Keep your password safe — one person, one account.

2.1 Age requirement

DojoWell is intended for users aged 13 years and older. If you are under the age of legal majority in your country (which is 18 in Saudi Arabia and most jurisdictions), you may use DojoWell only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf.

If you are under 13, please do not use DojoWell. We do not knowingly collect personal information from children under 13. If we discover that a user is under 13, we will close the account and delete the associated personal data. Parents or guardians who believe their child under 13 has provided personal information may contact us at helpdesk@dojowell.com.

2.2 Account creation

When you sign up, you must provide accurate, current, and complete information, and keep it up to date. You may sign up using an email address and password, an Apple ID (Sign in with Apple), or a Google account. By signing in via Apple or Google, you authorise us to receive a limited set of profile data from those providers as described in our Privacy Policy.

2.3 Account security

You are responsible for keeping your password confidential, for all activity that occurs under your account, and for notifying us immediately if you suspect your account has been compromised. DojoWell is not liable for any loss or damage arising from your failure to safeguard your account credentials.

2.4 One account per person

You may only create and use one account at a time. You may not share your credentials with another person, transfer your account, or create an account for another person — except as a parent or guardian creating an account for a minor in your care.

2.5 Termination of your account

You may delete your account at any time through the app's Settings, or by emailing helpdesk@dojowell.com.

We may suspend or terminate your account, with or without notice, if (i) you breach these Terms, (ii) you use DojoWell unlawfully or in a way that harms other users or the service, or (iii) we are required to do so by law.

Upon termination, your access to paid features will end at the end of your current billing period (unless we are required to terminate earlier under law). Some data may be retained as required by law or as set out in the Privacy Policy. Sections that by their nature should survive termination — including intellectual property, indemnification, and dispute resolution — will survive.

3. The DojoWell Service

In short: DojoWell is content and tools to help you understand and complete the emotional, behavioural, and cognitive loops that modern life triggers. It is not medical care, therapy, or a substitute for a licensed professional.

3.1 What DojoWell offers

DojoWell offers:

  • Educational content — articles, the Meaning-Density framework, the science section, the concepts glossary, pillar pages, and the meaning-framework essays — written and produced by DojoWell.
  • Self-assessment tools — including the matrix-quiz and other guided assessments — designed for personal reflection.
  • A guided journey through structured levels (the "7-Levels Journey") combining reflection, content, and habit-building exercises.
  • Habit and loop-tracking tools in our mobile app.
  • Audio content — guided sessions, ambient pieces, and exercises.

3.2 What DojoWell is not

DojoWell is not:

  • Medical care, therapy, psychiatry, psychology, counselling, coaching, or any other licensed health service.
  • A substitute for professional advice from a licensed physician, psychologist, therapist, dietitian, or other qualified health professional.
  • A diagnostic tool. Our quizzes and assessments are for personal reflection only — they do not produce a diagnosis.
  • An emergency service. If you are in crisis or considering self-harm, please contact emergency services in your country (see Section 6).

3.3 Our content is informational

The content on DojoWell — including our framework (Meaning-Density Theory), articles, glossary, art, audio, and assessments — is informational and educational. It reflects our perspective and the perspectives of our contributors. It is not advice, and you use it at your own risk. If you have questions about your physical or mental health, please consult a licensed professional.

3.4 Service availability and changes

We are continuously developing DojoWell. We may, at any time and without prior notice, add, remove, or change features, content, or tools; discontinue parts of the service; or limit access in certain jurisdictions for legal or operational reasons. We will give reasonable notice when changes materially affect your paid subscription rights — see Section 4.

We do not guarantee uninterrupted access. The service may be unavailable due to maintenance, third-party service outages, internet issues, or events beyond our reasonable control.

4. Subscriptions, Pricing & Payment

In short: Some of DojoWell is free; some requires a paid subscription. Subscriptions auto-renew until cancelled. You manage and cancel mobile subscriptions through the App Store or Google Play. Web subscriptions are billed by Paddle. Refunds are governed by our Refund Policy and the rules of the channel where you bought.

4.1 Free vs. paid features

Some DojoWell content and features are available for free. Other features — including the full 7-Levels Journey, the complete content library, premium audio, and personalised habit tracking — require a paid subscription. Whether a feature is free or paid may change as we develop the service.

4.2 Where you pay matters

DojoWell sells subscriptions through three channels, and the channel determines who is the "merchant of record" and how to cancel:

For mobile subscriptions, your contract for payment is also subject to Apple's or Google's terms in addition to ours. We cannot process refunds for App Store or Google Play purchases — those are handled by Apple or Google directly. For web subscriptions, your contract for payment is also governed by Paddle's Buyer Terms.

4.3 Auto-renewal

Subscriptions automatically renew at the end of each billing cycle (typically monthly or annually) at the then-current price, charged to your stored payment method, until cancelled. You will receive renewal reminders where required by law (for example, for annual subscriptions in many jurisdictions, including KSA and the EU/UK).

4.4 Free trials and promotional pricing

If you start a free trial or accept a promotional price, your subscription will automatically convert to a paid subscription at the standard price when the trial or promotional period ends, unless you cancel before that period ends. We will send a reminder before the trial ends where required by law.

4.5 Cancellation

You can cancel any time via the channel where you subscribed (see the table in 4.2). When you cancel, your subscription remains active until the end of the current billing period; you will not be charged again unless you re-subscribe; and you will not receive a refund for the unused portion of the current billing period, except as required by law or as set out in our Refund Policy.

4.6 Refunds

Our Refund Policy governs refunds for web purchases through Paddle. Mobile-store refunds are governed by Apple and Google directly. Where local consumer law gives you a stronger right (for example, the 14-day right of withdrawal in the EU), that law applies.

4.7 Pricing and currency

Prices are listed at the point of purchase. We may change pricing at any time. Price changes apply only to future billing cycles, and we will give notice before any price increase takes effect on a renewal. Mobile-store prices are converted to your local currency by Apple or Google. Web prices are listed in the currency shown at checkout.

4.8 Taxes

Prices may be exclusive or inclusive of taxes depending on your location and the channel of purchase:

  • Saudi Arabian users: Saudi VAT at the prevailing rate (currently 15%) applies and is collected by Apple, Google, or Paddle as the merchant of record.
  • Users in other jurisdictions: applicable VAT, GST, or sales tax (if any) is collected and remitted by Apple, Google, or Paddle as the merchant of record for your purchase.

DojoWell does not directly collect or remit consumer-level VAT or sales tax.

4.9 Payment failures

If we (or Paddle, Apple, or Google) cannot charge your stored payment method, we may retry the charge, suspend access to paid features until payment is received, or cancel your subscription after a reasonable retry period. You remain responsible for fees properly charged before suspension or cancellation.

5. Acceptable Use

In short: Use DojoWell legally and respectfully. Don't break it, copy our content for resale, harass other users, or do anything illegal where you live.

5.1 What you agree to

You agree to use DojoWell only for lawful purposes, in line with these Terms and any in-app rules we publish, and for your own personal, non-commercial use unless we expressly licence you otherwise.

5.2 What you must not do

You agree not to:

  • Reverse-engineer, decompile, or attempt to derive the source code of our apps or website (except where this prohibition is unenforceable under your local law).
  • Scrape, crawl, or extract content from DojoWell at scale, including for AI training, except as expressly permitted in our robots.txt and llms.txt.
  • Resell, redistribute, sublicense, or commercially exploit any DojoWell content — including our Meaning-Density framework — without our prior written permission.
  • Upload or transmit malicious code, viruses, or anything that could damage DojoWell, our infrastructure, or other users.
  • Probe, scan, or test the vulnerability of DojoWell systems, except under a written authorised security-research arrangement with us. Responsible reports are welcome at helpdesk@dojowell.com (subject: "Security report").
  • Use DojoWell to harass, defame, or threaten any person.
  • Impersonate another person or misrepresent your identity.
  • Circumvent any access controls, paywalls, or rate limits.
  • Use bots, scripts, or automated systems to access DojoWell, except for search engines and AI crawlers permitted by our robots.txt.
  • Use DojoWell in violation of applicable export-control laws or trade sanctions (see Section 16).

5.3 Consequences

If you breach this section, we may suspend or terminate your account (Section 2.5), pursue legal remedies, and/or refer the matter to law enforcement.

6. Health & Wellness Disclaimer

In short: DojoWell is not medical or mental-health care. Our content is informational only. If you are in crisis, contact emergency services. For ongoing concerns, see a licensed professional.

6.1 Not medical advice

DojoWell does not provide medical care, mental-health treatment, therapy, psychiatry, or any other licensed health service. Our content, frameworks, quizzes, and tools are informational and educational only. They are not a substitute for professional advice, diagnosis, or treatment. You should always consult a licensed healthcare professional regarding any medical or mental-health condition, before starting any new exercise or wellness practice, and before changing existing treatment.

6.2 No therapeutic relationship

Use of DojoWell does not create any doctor-patient, therapist-client, counsellor-client, or other professional relationship between you and DojoWell, our employees, or our contributors.

6.3 In an emergency

If you are in immediate danger, considering self-harm, experiencing a mental-health emergency, or in any life-threatening situation, please contact your local emergency services. Examples:

  • Saudi Arabia: National emergency 911. Ministry of Health mental-health line 920033360.
  • United States: Suicide & Crisis Lifeline 988. Emergency 911.
  • United Kingdom: Samaritans 116 123. Emergency 999.
  • European Union: Pan-European emergency 112.
  • Elsewhere: please contact your local emergency services.

These numbers are provided as a courtesy and may change. DojoWell is not a crisis service. Do not use our chat, support email, or any other DojoWell channel to seek emergency help.

6.4 Responsibility for your own wellbeing

You assume full responsibility for any decisions you make based on DojoWell's content, including changes to your habits, routines, exercise, sleep, diet, or any wellness practice. We are not liable for any outcome arising from your reliance on DojoWell content.

7. Intellectual Property

In short: DojoWell — the content, framework, art, software, and brand — is ours. Subscribing gives you a limited, personal licence to use it. It does not give you the right to resell it, republish it, or use it to train AI for commercial use.

7.1 Our content

All content on DojoWell — including (without limitation) text articles, the meaning-framework, the science section, the concepts glossary, pillar pages, visual art and the art-piece library, audio sessions, the Meaning-Density Theory framework and its terminology (including "Loop Sovereignty," "Meaning-Density," "Done Signal," and other proprietary terms), DojoWell software (apps, website, APIs), trademarks, logos, and brand assets — is the intellectual property of Establishment Dojo Tech or our licensors, protected by copyright, trademark, trade-secret, and other applicable intellectual-property laws in Saudi Arabia and internationally.

7.2 Your licence

Subject to these Terms and your active subscription (where applicable), we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use DojoWell on devices you own or control, and to view, listen to, and personally engage with our content for your own non-commercial use.

This licence is personal. It does not include the right to:

  • Copy, reproduce, distribute, publicly display, broadcast, or perform our content except as the platform itself enables.
  • Use our content for any commercial purpose, including training or fine-tuning AI/ML models intended for commercial use.
  • Modify, adapt, translate, or create derivative works from our content.
  • Remove any copyright, trademark, or other proprietary notice.

7.3 Trademarks

"DojoWell," the DojoWell logo, "Meaning-Density Theory," "MDT," "Loop Sovereignty," and other DojoWell marks (whether registered or unregistered) are trademarks of Establishment Dojo Tech. You may not use them without our prior written consent.

7.4 Feedback

If you send us feedback, suggestions, or ideas about DojoWell, we may use them without obligation or compensation to you. By submitting feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use it for any purpose. We will not identify you publicly without your consent.

8. User-Generated Content

In short: Anything private (your reflections, journal entries) stays private. Anything you choose to make public, you keep — but you give us a licence to host and display it.

8.1 Your private journaling

If you use DojoWell's habit-tracking, journaling, or reflection features, your entries are stored in your account and treated as private personal data under our Privacy Policy. We do not display them publicly or share them with other users without your explicit consent.

8.2 Public submissions

If you submit content to a public area of DojoWell — including (but not limited to) reviews, public comments, or featured stories you opt into — you retain ownership of that content, but you grant us a worldwide, royalty-free, non-exclusive licence to host, display, reproduce, distribute, translate, adapt, and use that content in connection with operating, promoting, and improving DojoWell.

8.3 Your representations

By submitting any content to DojoWell, you represent and warrant that you own or have the necessary rights to the content; the content does not violate the rights of any third party (including copyright, trademark, privacy, or publicity rights); and the content is not unlawful, defamatory, harassing, abusive, sexually explicit, or in violation of these Terms.

8.4 Removal

We may remove user-submitted content at any time, with or without notice, if we believe it violates these Terms or applicable law.

9. Copyright Claims (Voluntary DMCA-Style Policy)

In short: Even though we are a Saudi entity not subject to the US DMCA, we voluntarily honour DMCA-style takedown requests as a courtesy to rights-holders.

DojoWell respects the intellectual-property rights of others. Although DojoWell is not a US-based entity and is not subject to the Digital Millennium Copyright Act ("DMCA"), we voluntarily follow a DMCA-style takedown process.

9.1 How to file a takedown notice

If you believe content on DojoWell infringes your copyright, please send a written notice to helpdesk@dojowell.com (subject line: "DMCA Notice") containing:

  1. A physical or electronic signature of the copyright owner or authorised agent.
  2. Identification of the copyrighted work claimed to be infringed.
  3. Identification of the material on DojoWell claimed to be infringing, with enough detail (e.g., URL) for us to locate it.
  4. Your contact information (name, address, email, phone).
  5. A statement that you have a good-faith belief that the disputed use is not authorised.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.

9.2 Counter-notice

If your content was removed and you believe the removal was a mistake or misidentification, you may submit a counter-notice with: (i) your physical or electronic signature; (ii) identification of the material removed and where it appeared; (iii) a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; and (iv) your contact information and a statement consenting to jurisdiction in Saudi Arabia (or your local jurisdiction, where required by law).

9.3 Repeat infringers

We will terminate accounts of users who are repeat copyright infringers in accordance with this policy.

10. Third-Party Services

In short: DojoWell relies on third-party services (Apple, Google, Paddle, RevenueCat, AWS, Firebase). Their terms also apply when you use those services through us.

10.1 Services we use

DojoWell uses third-party services to operate the platform, including (without limitation):

  • Apple Inc. — App Store distribution and iOS in-app payments.
  • Google LLC — Google Play distribution, Android in-app payments, Firebase services.
  • Paddle.com Inc. — web payment processing and merchant of record for web subscriptions.
  • RevenueCat, Inc. — subscription management for mobile in-app purchases.
  • Amazon Web Services (AWS) — hosting, content delivery, and storage.
  • Firebase Crashlytics — crash and stability reporting.

When you use DojoWell, you also use these third-party services, and their terms and privacy policies apply alongside ours. We are not responsible for the content, terms, or practices of third parties.

10.2 Outbound links

DojoWell may contain links to third-party websites or resources. We do not control these and are not responsible for their content, accuracy, or privacy practices. Following such links is at your own risk.

11. Privacy & Data Protection

In short: Our Privacy Policy explains how we handle your data. We comply with Saudi PDPL, EU/UK GDPR, and CCPA/CPRA where they apply.

11.1 Cross-reference

How DojoWell collects, uses, and protects your personal data is governed by our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

11.2 Saudi Personal Data Protection Law (PDPL)

DojoWell complies with the Saudi Personal Data Protection Law (Royal Decree M/19, as amended) and its implementing regulations issued by the Saudi Data and AI Authority (SDAIA). For Saudi Arabian users, the Privacy Policy explains your rights and how to exercise them.

11.3 EU/UK GDPR

If you are a resident of the European Economic Area, the United Kingdom, or Switzerland, the EU General Data Protection Regulation, the UK GDPR, and the Swiss Federal Data Protection Act apply to our processing of your personal data. The Privacy Policy explains your rights (access, rectification, erasure, portability, restriction, objection) and how to exercise them.

11.4 California (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act and California Privacy Rights Act give you specific rights regarding your personal information. The Privacy Policy explains those rights and how to exercise them.

11.5 International data transfers

Because DojoWell is operated from Saudi Arabia and uses cloud infrastructure provided by international vendors, your data may be transferred to and processed in countries outside your country of residence, including the United States and the European Union. We use safeguards required by applicable law (including standard contractual clauses where relevant).

12. Communications

In short: By signing up, you consent to receive transactional emails from us (account, billing, security). You can opt out of marketing emails any time.

12.1 Transactional communications

By creating a DojoWell account, you agree that we may send you communications related to your account, your subscription, and the service — including confirmations, billing notices, security alerts, and material policy changes. These are service-essential and you cannot opt out of them while you have an active account.

12.2 Marketing communications

We may send marketing communications (newsletters, product updates, offers) where you have consented or where applicable law permits. You can withdraw consent at any time by clicking "unsubscribe" in any marketing email, updating your preferences in your account settings, or emailing helpdesk@dojowell.com.

12.3 SMS

If you provide a phone number and opt in to SMS, standard message and data rates may apply. You may opt out by replying STOP or contacting us.

12.4 Method of communication

We may communicate with you by email, in-app notification, push notification, or any reasonable method using the contact details associated with your account.

13. Disclaimers & Limitation of Liability

In short: DojoWell is provided "as is." Our liability is capped at the greater of (a) what you paid us in the last 12 months or (b) USD 100. None of this overrides any consumer-protection rights you have under your local law that cannot be waived.

13.1 Service "as is"

To the maximum extent permitted by law, DojoWell is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including (without limitation) implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or quiet enjoyment.

13.2 No guarantees about content or outcomes

We do not warrant that our content is accurate, complete, or current; that the service will be uninterrupted, secure, or error-free; that defects will be corrected; or that any specific outcome (including health, wellness, or behavioural change) will result from using DojoWell.

13.3 Limitation of liability

To the maximum extent permitted by law, DojoWell, its directors, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, data, or use; damages arising from your reliance on our content; damages arising from your inability to access DojoWell; or damages arising from third-party content, services, or links.

Our total cumulative liability to you for any claim arising out of or related to DojoWell or these Terms is limited to the greater of:

  • (a) The total amount you paid to DojoWell (or our payment processors on our behalf) in the twelve (12) months before the event giving rise to the claim, or
  • (b) USD 100 (or its equivalent in your local currency).

13.4 Mandatory rights preserved

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. Where you are a consumer (and not a business) and the law of your country gives you rights that cannot be waived, those rights apply notwithstanding anything else in this Section 13. This includes (without limitation) your rights under the Saudi Consumer Protection Law and the Saudi Civil Transactions Law; the EU Consumer Rights Directive and applicable national consumer laws; the UK Consumer Rights Act 2015; and similar consumer-protection laws in your jurisdiction.

Nothing in these Terms excludes or limits liability for fraud, gross negligence, wilful misconduct, or any other liability that cannot be excluded by applicable law.

14. Indemnification

In short: If your use of DojoWell causes a third party to sue us, you agree to cover our reasonable costs (subject to limits in your local consumer law).

To the extent permitted by applicable law, you agree to indemnify and hold harmless Establishment Dojo Tech, its directors, officers, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to (i) your breach of these Terms, (ii) your violation of any law or third-party right, (iii) your misuse of DojoWell, or (iv) content you submit to DojoWell.

We will notify you of any such claim and may, at our option, control the defence. You agree to cooperate reasonably with us at your expense. You may not settle any claim that affects DojoWell's interests without our prior written consent. This Section 14 does not apply where applicable consumer law restricts indemnification by consumers.

15. Governing Law & Disputes

In short: These Terms are governed by Saudi law. We try informal resolution first. If that fails, disputes go to the Saudi Center for Commercial Arbitration (SCCA) in Riyadh — except where local consumer law gives you the right to use your home courts. None of this takes away rights you have under your local consumer-protection law.

15.1 Governing law

These Terms, your use of DojoWell, and any non-contractual obligations arising out of or in connection with them are governed by the laws of the Kingdom of Saudi Arabia, without regard to conflict-of-laws principles.

15.2 Informal resolution first

Before filing any formal dispute, you agree to first contact us at helpdesk@dojowell.com (subject line: "Dispute Notice") with a written description of the issue. We will work in good faith to resolve the issue informally for a period of at least 60 days from receipt of the notice.

15.3 Arbitration

If we cannot resolve the dispute informally, you and DojoWell agree to submit any dispute, controversy, or claim arising out of or in connection with these Terms (including its existence, validity, interpretation, performance, breach, or termination) to binding arbitration administered by the Saudi Center for Commercial Arbitration (SCCA) in accordance with the SCCA Arbitration Rules in force at the time of the request.

  • Seat of arbitration: Riyadh, Kingdom of Saudi Arabia.
  • Language: English (with Arabic translation made available where required).
  • Number of arbitrators: One.
  • Costs: Each party bears its own legal costs unless the tribunal awards otherwise.

The arbitration award is final and binding.

15.4 Consumer exception

Notwithstanding Section 15.3, if you are a consumer (a natural person using DojoWell for personal, non-commercial purposes) and the consumer-protection law of your country of residence grants you the right to bring proceedings in your local courts (for example, EU/UK consumer law typically does), you may bring those proceedings in your local courts and you are not required to arbitrate. We agree that, where you so choose, the courts of your country of habitual residence have jurisdiction.

15.5 Class actions

Disputes are resolved on an individual basis. To the extent permitted by applicable law, you and DojoWell each waive the right to bring or participate in any class action, collective action, or representative proceeding. Where local law does not permit such a waiver, this Section 15.5 does not apply to you.

15.6 Injunctive relief

Notwithstanding the arbitration provision, either party may seek injunctive or equitable relief from a court of competent jurisdiction to protect intellectual property rights, confidential information, or to prevent unauthorised access to DojoWell.

16. International Use & Sanctions

In short: Don't use DojoWell where it's illegal, and don't use it if you're on a sanctions list.

16.1 Availability

DojoWell is available globally except where prohibited by law. Some features may be limited in certain jurisdictions. You are responsible for complying with the laws of your jurisdiction.

16.2 Sanctions and export controls

You represent and warrant that you are not located in, or a national or resident of, any country subject to comprehensive trade sanctions; you are not on any list of persons or entities subject to Saudi, US, UN, EU, or UK trade-restriction lists; and you will not use DojoWell in violation of any applicable export-control or sanctions law.

16.3 Local-law compliance

You are responsible for complying with any local laws applicable to you, including those relating to the import or export of software, content, or services.

17. General Provisions

17.1 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations to an affiliate or to a successor in connection with a merger, acquisition, restructuring, or sale of assets — provided the assignee assumes our obligations.

17.2 Notices

Notices to you may be sent to your registered email address, posted in-app, or made available on dojowell.com. Notices to us must be sent to helpdesk@dojowell.com or by registered post to: 13A Alshula, Dammam, Eastern Province, Kingdom of Saudi Arabia.

17.3 Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force. The unenforceable provision will be interpreted, modified, or replaced to the minimum extent needed to make it enforceable while preserving its intent.

17.4 No waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

17.5 Entire agreement

These Terms (together with the Privacy Policy, Refund Policy, and any policies referenced in Section 1.3) constitute the entire agreement between you and DojoWell regarding the service and supersede any prior agreements.

17.6 Force majeure

Neither party is liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, internet or utility outages, pandemic, or labour disputes.

17.7 Headings

Section headings are for convenience only and do not affect interpretation.

17.8 Relationship

These Terms do not create any agency, partnership, joint venture, or employment relationship between you and DojoWell.

17.9 Third-party beneficiaries

These Terms are for the benefit of you and DojoWell only. There are no third-party beneficiaries except our affiliates, directors, officers, employees, and licensors with respect to the disclaimer, limitation of liability, and indemnification provisions.
